SCOTUS: Hate Speech still Free Speech
Calling all leftist, and conservative snowflakes who bombarded the Julius Caesar play! Have you heard that hate speech is still free speech?!
Today in a Supreme Court 8-0 ruling, they have stated that hate speech is still free speech. According to Ben Shapiro of the Daily Wire, "The case concerned the attempt to register a band called "The Slants" for trademark. The trademark office refused the trademark on the grounds that it was an offensive term for Asians."
The opinion of the case was broken into two parts. Justice Samuel Alito represents four justices, and Justice Anthony Kennedy represents the other four.
Justice Alito wrote:
"Speech that demeans on the basis of race, ethnicity, gender, religion, age, disability, or any other similar ground is hateful; but the proudest boast of our free speech jurisprudence is that we protect the freedom to express 'the thought we hate.'"
Justice Kennedy wrote:
"A law found to discriminate based on viewpoint is an "egregious form of content discrimination," which is "presumptively unconstitutional,"... A law that can be directed against speech found offensive to some portion of the public can be turned against minority and dissenting views to the detriment of all." He concludes with, "The First Amendment does not entrust that power to the government's benevolence. Instead, our reliance must be on the substantial safeguards of free and open discussion in a democratic society."
Now, this is important for a couple reasons and I will debunk them for you.
Whenever someone on the left gets their feelings hurt, they cry. They will make a big hoopla because they think someone with opposing views is being racist, a bigot, you name it. The problem with that is when their feelings are being hurt with facts, the only thing they can level down to is name calling because they know what they are being told is true.
During my second semester freshman year, I read a book called Confident Pluralism by John Inazu (amazing book, I highly recommend). The book focuses on the argument "that we can and must live together peaceably in spite of deep and sometimes irresolvable differences...." no matter what the issue. This is a hard concept for the left because they do not like coexisting with people who are not like-minded. The left will name call, ridicule, and try so hard to shut up opposing views. The left needs to learn that protecting speech that they hate is far more important because sooner or later speech that they do like will be taken away as well. I mean if the worst concept to them is getting offended over a couple of words, they need a reality check because far worse is going to be coming towards them.
So for closing, let's all remember that hate speech is free speech and a couple of hurtful words should not matter to you. The First Amendment is one of the core values that we have as a free society. If there is no direct evidence of violence due to speech, do not cry wolf. All we would be doing is causing violence to the amendment itself.
